PUBLIC AUCTION FOR THE SALE OF 1 CAR<\/b><\/p>\n

USED OWNED BY IRVOS.<\/b><\/p>\n

 <\/p>\n

In execution of Regional Law n. 09\/2013 art. 22, relating to the ban on public administrations from owning and using cars exceeding 1300 cc in engine capacity, IRVOS will, through a public auction, sell the vehicle listed below:<\/p>\n

\u2013 SUBJECT OF THE AUCTION<\/b><\/p>\n

The car will be put up for sale in its current state. The IRVOS<\/p>\n

is not responsible for any hidden defects in the goods sold. The successful tenderer will therefore not be able to<\/p>\n

raise exceptions in this regard.<\/p>\n

The car up for auction is the following:<\/p>\n

 <\/b><\/p>\n

\u2013 VISION OF VEHICLES<\/b><\/p>\n

Those interested in purchasing the goods described above can view the vehicles with the<\/p>\n

relevant documentation in the possession of the Institution, by appointment. To this end they can contact<\/p>\n

at the Consignee's Office, at the headquarters in Via Libert\u00e0, n. 66\u2013 Palermo tel. 091-<\/p>\n

6278250 or 091 6278244, from Monday to Friday, from 8.30am to 12.30pm. Taking requests<\/p>\n

Views of the vehicles must arrive by 12.00 on 18\/07\/2014.<\/p>\n

 <\/p>\n

\u2013 SUBJECTIVE REQUIREMENTS TO PARTICIPATE IN THE AUCTION<\/b><\/p>\n

To participate in the auction procedure, bidders must possess the following requirements, which must be attested<\/p>\n

with declaration to be made pursuant to Presidential Decree 445\/2000:<\/p>\n

\u2013 not be disqualified, disabled or bankrupt or subjected to other insolvency or non-insolvency proceedings<\/p>\n

have ongoing procedures for the declaration of any of these states:<\/p>\n

\u2013 there are no convictions or other measures against you that would lead to loss<\/p>\n

o the suspension of the ability to contract with the Public Administration;<\/p>\n

\u2013 not be insolvent towards the Province of Parma for sums of money owed<\/p>\n

for taxes, fees, rents, indemnities, fees or any other title.<\/p>\n

 <\/p>\n

\u2013 AWARD CRITERION<\/b><\/p>\n

The auction will be held using the secret offer method and the award will take place using the criterion<\/p>\n

of the highest bid compared to the tender amount.<\/p>\n

 <\/p>\n

\u2013 PARTICIPATION METHODS AND SUBMISSION TERMS<\/b><\/p>\n

OF OFFERS.<\/b><\/p>\n

To participate in the tender, the competitor must send IRVOS a package for which he intends to submit an offer, containing the documentation referred to below.<\/p>\n

Conditional offers are not permitted.<\/p>\n

The application for participation in the auction and the offer must be drawn up exclusively in the language<\/p>\n

Italian.<\/p>\n

Persons interested in participating in the auction must send exclusively to the following<\/p>\n

address:<\/p>\n

REGIONAL INSTITUTE OF WINE AND OLIVE OIL - Consignee's Office -<\/b><\/p>\n

Via della Libert\u00e0, 66 \u2013 90143 Palermo<\/b><\/p>\n

no later than 12.00 on the day 17.12.2014<\/b> (peremptory term) an envelope duly closed and sealed and countersigned on all closing flaps. The package must bear the words "Auction<\/b><\/p>\n

public for the sale of n. 1 car owned by IRVOS"<\/b><\/p>\n

as well as the name and address of the sender.<\/p>\n

The package must be delivered directly by hand to the aforementioned address or delivered to<\/p>\n

by registered mail. Any other means of delivery will not be considered valid, therefore i<\/p>\n

competitors who have not respected this provision will not be admitted to the auction.<\/p>\n

The timely and regular delivery of the package is at the sender's sole risk. The deadline has passed<\/p>\n

fixed for the reception of applications, no offer will be recognized as valid, even if it replaces it<\/p>\n

or additional to a previous offer and even if the delay is due to force majeure. Not<\/p>\n

Applications for participation or offers containing abrasions or corrections are permitted.<\/p>\n

DOCUMENTATION<\/p>\n

Under penalty of exclusion, the package must contain two envelopes, each of which is sealed<\/p>\n

and countersigned on the closing flaps and the words, respectively, \u201cA \u2013 APPLICATION FOR<\/p>\n

PARTICIPATION\u201d and \u201cB \u2013 ECONOMIC OFFER\u201d.<\/p>\n

On the outside of both envelopes, it must be indicated the sender, <\/b>and the following wording \u201cPublic auction for the sale of n. 1 car owned by IRVOS\u201d.<\/b><\/p>\n

-Envelope \u201cA \u2013 APPLICATION FOR PARTICIPATION\u201d<\/p>\n

The "APPLICATION FOR PARTICIPATION" envelope must contain, under penalty of exclusion, the<\/p>\n

following documentation:<\/p>\n

a) application to participate in the auction, drawn up in Italian, duly signed. At the<\/p>\n

The application must be accompanied by a photocopy, front-back, of an identity document (in progress<\/p>\n

validity) of the subscriber.<\/p>\n

In the case of an attorney, the original or certified copy of the notarial power of attorney must also be attached<\/p>\n

notarial.<\/p>\n

In the case of a company, the application must be completed and signed by the legal representative of the company<\/p>\n

itself or by another person with suitable powers of representation.<\/p>\n

The application for participation must contain: under penalty of exclusion, the declarations listed<\/p>\n

in Annex A)<\/a> <\/b>to this Notice, to be made pursuant to art. 46 and 47 of Presidential Decree 445\/2000.<\/p>\n

-Envelope \u201cB \u2013 ECONOMIC OFFER\u201d must contain, under penalty of exclusion, the following<\/p>\n

documentation:<\/p>\n

a) Financial offer, drawn up on stamp duty and in Italian, expressed in figures and letters, relating to the<\/p>\n

single Lot, duly signed in full. The financial offer must be attached in the<\/p>\n

same envelope, photostatic copy, front-back, of an identity document (valid)<\/p>\n

of the subscriber. The offer must contain, under penalty of exclusion, the declarations listed<\/p>\n

in Annex B)<\/a> <\/b>to this Notice.<\/p>\n

In case of discrepancy between the amounts indicated in figures and those in words, for the purposes of the award,<\/p>\n

those most advantageous for IRVOS will prevail.<\/p>\n

Economic offers must be equal to or greater than the base price<\/p>\n

of auction. Bids of an amount lower than the starting auction price will not be taken into consideration.<\/p>\n

Bids made by a person to be nominated will not be accepted.<\/p>\n

The award may be made even if only one valid offer is submitted.<\/p>\n

 <\/p>\n

 <\/p>\n

\u2013 METHOD OF CONDUCTING THE AUCTION<\/b><\/p>\n

The auction will be chaired by a special duly constituted Commission and will take place with<\/p>\n

secret bidding system.<\/p>\n

The tender commission at 10.00 am on 18\/12\/2014, at the IRVOS headquarters in Via<\/p>\n

della Libert\u00e0, 66 \u2013 Palermo, will proceed with the opening of the packages received,<\/p>\n

following verification of the applications for participation, the provisional award will be made,<\/p>\n

in favor of the bidder who has submitted the highest offer.<\/p>\n

In case of discrepancy between the offer price in figures and that indicated in words it will be considered<\/p>\n

the most advantageous one for the Administration is valid.<\/p>\n

The auction will be a single and definitive auction and the award will be made even in the case of a single auction.<\/p>\n

valid offer.<\/p>\n

In case of equal offers, the art. will apply. 77 paragraph 2 of RD n. 827\/1924, that is, yes<\/p>\n

will proceed by drawing lots.<\/p>\n

Competitors who have submitted an offer, equipped with an identification document, can<\/p>\n

participate in the competition session as listeners.<\/p>\n

IRVOS reserves the right to change the date of the auction session; then<\/p>\n

timely communication will be given by publishing a notice on the website (www.irvos.it<\/a>).<\/p>\n

 <\/p>\n

\u2013 FINAL AWARD<\/b><\/p>\n

The final award will be made through determination, once the appropriate procedures have been completed<\/p>\n

checks.<\/p>\n

Once the award has been made, the documents for the vehicle(s) will be delivered to the winning bidder<\/p>\n

the operations relating to the transfer of ownership, which must be carried out at the care and expense<\/p>\n

of the successful tenderer himself and to be agreed upon in terms and methods with the Consignee's Office.<\/p>\n

 <\/p>\n

\u2013 PAYMENT OF THE PRICE<\/b><\/p>\n

The successful tenderer must pay the sum no later than 5 (five) days from the date of<\/p>\n

award, otherwise he will be considered to have lost all rights.<\/p>\n

The signing of the sales contract is subject to payment of the price to the IRVOS-Accounting Office to be made by paying the same to the Institution's Treasury.<\/p>\n

As regards the unit awarded, the collection of the vehicle must take place after the payment of the<\/p>\n

balance and upon presentation of the documents certifying the new ownership which must in any case be<\/p>\n

copied to the Institution no later than 5 days after notification of the notification<\/p>\n

award.<\/p>\n

 <\/p>\n

\u2013 STIPULATING THE DEED OF PURCHASE<\/b><\/p>\n

The successful tenderer must prove that he has paid the price offered by bank transfer<\/p>\n

bank and\/or by bank draft, upon signing the transfer of ownership.<\/p>\n

The cars will be delivered after the aforementioned passage has been completed.<\/p>\n

All costs for stipulating registration and transcription of the deed of sale and any other deed<\/p>\n

arising and consequent, will be borne by the buyer.<\/p>\n

 <\/p>\n

\u2013 OTHER PROVISIONS RELATING TO THE PROCEDURE.<\/b><\/p>\n

The Regional Institute of Wine and Oil of Palermo reserves the right, at its sole discretion and at any stage of the procedure, not to hold the auction, to revoke it, to extend it, to suspend it and\/or to postpone it to another date, without the participants being able to make any claims in this regard.<\/p>\n

\u2013 DISPUTES<\/b><\/p>\n

For any dispute that may arise, the Court of Palermo is competent<\/p>\n

The attachments to this Notice constitute, for all intents and purposes, an integral and substantial part thereof<\/p>\n

 <\/p>\n

\u2013 PROCEDURE AND INFORMATION MANAGER<\/b><\/p>\n

Pursuant to art. 5 of Law 241\/1990 we inform you that the person responsible for the procedure is Mr. Rosario Geraci, consignee of the organisation.<\/p>\n

This Notice and the related attachments in electronic format are available on the IRVOS website (www.irvos.it<\/a>).<\/p>\n

 <\/p>\n

\u2013 DATA PROCESSING<\/b><\/p>\n

Pursuant to art. 13 of Legislative Decree 196\/2003 we inform you that:<\/p>\n

\u2013 the processing of personal data provided by auction participants has the purpose of ensuring<\/p>\n

the carrying out of the same and the consequent obligations;<\/p>\n

\u2013 any refusal to make the required declarations will result in exclusion from the<\/p>\n

auction procedure:<\/p>\n

\u2013 the data relating to the subjects participating in the auction may be communicated to the competent offices<\/p>\n

public, to subjects external to the IRVOS of Palermo involved in the procedure, to<\/p>\n

participating competitors, to other subjects entitled pursuant to Law 241\/1990;<\/p>\n

\u2013 the owner of the processing of personal data is Irvos of Palermo.<\/p>\n
